Benedito Nunes, aclamado filósofo e crítico literário, guarda em sua biografia um período de formação jurídica na Faculdade de Direito do Pará, entre os anos de 1948 e 1952. Este é um dado que normalmente fica isolado na observação de sua trajetória, sobretudo em relação aos aspectos intelectuais da formação jurídica, fator que pode permitir uma maior compreensão sobre a construção do pensamento do filósofo. Diante dessa percepção, o presente trabalho tem como objetivo analisar a formação jurídico-filosófica propiciada pela Faculdade (...) de Direito do Pará ao estudante Benedito Nunes, dando ênfase aos estudos realizados em “Introdução à Ciência do Direito”, disciplina ministrada pelo professor Daniel Coelho de Souza. Para tanto, utiliza-se como base os dossiês acadêmicos albergados pelo Arquivo da atual Faculdade de Direito da Universidade Federal do Pará (UFPA) e demais fontes que auxiliam o trabalho a partir da perspectiva da História Intelectual. Em conclusão, nota-se que a Faculdadem de Direito do Pará foi um ambiente que contribuiu para a formação da visão de mundo de seus bacharéis, em especial de Benedito Nunes, por meio da formação filosófica rica em temas de Teoria do Conhecimento, abrindo possibilidades para um pensamento universal. Um dos pais fundadores da psicoterapia existencial- Ludwig Binswanger- foi justamente criticado por Martin Heidegger por excesso de formalismo e má compreensão da analítica existencial. Apesar destes reparos algumas contribuições de Binswanger, por estarem baseadas na sua experiência clínica, são, ainda hoje profícuas para uma interpretação do sofrimento, apresentado pelos nossos pacientes na clínica psicoterapêutica. É precisamente no caso da psicopatologia, tanto neurótica como psicótica, que a noção de projeto-de-mundo, apresenta um elevado valor heurístico e permite o desvelamento do modo (...) de ser-no-mundo do paciente, a partir do qual se torna clara a origem da estrutura essencial da experiência psicopatológica. Retomando o já célebre caso apresentado por Binswanger da menina em que se separou o tacão do sapato enquanto patinava, também comentado por Heidegger, apresenta-se uma discussão histórica do caso que permita exemplificar uma interpretação, respeitadora do método fenomenológico, que ilumina o seu projeto-de-mundo e identificar, como acontece com toda a Psicopatologia, quais os dados da existência, negados, escamoteados ou escotomizados e que consequências daí advêm. É também apresentada uma via psicoterapêutica, nestes casos, a partir do questionamento dos pressupostos do projeto-de-mundo, uma vez identificados pela análise existencial. (shrink)

In this article, we propose a belief revision approach for families of (non-classical) logics whose semantics are first-order axiomatisable. Given any such (non-classical) logic , the approach enables the definition of belief revision operators for , in terms of a belief revision operation satisfying the postulates for revision theory proposed by Alchourrrdenfors and Makinson (AGM revision, Alchourrukasiewicz's many-valued logic. In addition, we present a general methodology to translate algebraic logics into classical logic. For the examples provided, we analyse in what (...) circumstances the properties of the AGM revision are preserved and discuss the advantages of the approach from both theoretical and practical viewpoints. Personality disorders are among the most intriguing and fascinating mental disorders. As they are characterized by pathological traits, not signs and symptoms, they are unsuitable for treatment with psychotropic drugs or other biological treatments. A psychological understanding of these disorders is possible based on cognitive or psycho-dynamic explanations but the author argues that these theoretical models miss the essential point, as they Jack a foundational ground on what is specifically human in human beings, their humanitas. Any deviation from this ground (...) might lead to the so called de-humanization of medicine or other clinical disciplines. This paper proposes an existential understanding of personality disorders grounded on the being of man. A clinical practice oriented towards the phenomenological method conceives human beings as an “opening of meaning” where the entities of the world can show themselves. The “opening” however is structured and if one revealed content (for instance a biographical event) is misunderstood as a structural component that might generate a set of interrelated pathological personality traits. O presente artigo detém o intuito de analisar a implementação do sistema de precedentes judiciais adotado pelo Brasil no Novo Código de Processo Civil, diante da teoria de Ronald Dworkin. O Brasil historicamente adota o sistema denominado de Civil Law, o qual adota a lei como fonte principal do Direito, dando ao precedente judicial um caráter secundário e não vinculante. Ante a nova atualização legislativa do Código de Processo Civil de 2015, que vislumbra a adoção de um sistema de precedentes, (...) o Brasil deve superar diversas dificuldades para adequar este sistema ao ordenamento jurídico, pois a maior dificuldade provém do fato da ausência de costume ao observar os precedentes como fonte do Direito. O texto faz uma análise sobre os sistemas judiciais de Civil Law e Common Law trazendo a diferença entre os sistemas e as fontes do Direito que cada um adere, bem como disserta sobre as teorias relativas à Interpretação e Integridade de Ronald Dworkin. Por fim, investiga as alterações legislativas no Código de Processo Civil, bem como a fundamental importância das teorias de Dworkin para implementar no Brasil de maneira correta o sistema de precedentes judiciais. A metodologia utilizada foi o método indutivo de abordagem e o método de procedimento foi o método monográfico. As fontes de pesquisa utilizadas foram as mais diversificadas, tais como livros, artigos, pesquisas em sites, consulta de outras monografias, consulta de tese de mestrado e jurisprudências. (shrink)

De um lado a Ciência da Informação foi se consolidando no eixo occidental, a partir década de 1960, expandindo sua influência inteletual em países da America Latina, substuindo uma tradição francesa-europeia de Documentação, e como meio de controle ideológico e da informação; do outro surge uma proposta reativa do eixo comunista, a Informatika. Posto isto, pretende-se neste ensaio criar lugar pra reflexão acerca de alguns pontos em que a Informatika influenciou a Ciência da Informação ocidental, mais precisamente a estadunidense, sobretudo (...) nas primeiras décadas da Guerra Fria, como também o inverso, ou seja, as influências da CI dos Estados Unidos à Informatika. Para tanto, iniciaremos nossas reflexões a partir de duas escolas: a da Teoria Matemática da Comunicação e da Epistemologia Social. Posto isto, o problema de pesquisa incide na seguinte questão: Apesar dos aspectos mercadológicos e ideológicos tão distintos dos blocos capitalista e socialista, é possível verificarmos algumas convergências teóricas na construção da Ciência da Informação e da Informatika? Metodologicamente, trata-se de uma pesquisa bibliográfica, com aspectos exploratórios. Conclui-se que apesar da União Soviética apresentar distintamente a informação social e tê-la como algo importante ante a ideologia do partido socialista, foi visto que a informação científica e técnica também foi muito aprimorada e valorizada pelos soviéticos. Assim como os Estados Unidos não priorizaram sempre o aspecto técnico da informação. As duas vertentes – social e técnica - caminharam juntas, ora predominando mais uma, ora outra, nos dois blocos, dependendo do momento e dos objetivos. (shrink)

This chapter critically examines various proposals for liability of a person to defensive harm. Drawing on the idea that there is an important relationship between a person’s liability to be harmed and the enforceable duties that she incurs as a result of posing a threat to others, it demonstrates that no simple account of liability will be successful. As there are many considerations that bear on the duties that a person has, there are many considerations which bear on a person’s (...) liability to be harmed. This general claim is supported through a demonstration both that culpability without causation can ground liability, and that causal contribution without culpability can ground liability. (shrink)

In the paper below the authors describe three super-tasks. They show that although the abstract notion of a super-task may be, as Benacerraf suggested, a conceptual mismatch, the completion of the three super-tasks involved can be defined rather naturally, without leading to inconsistency, by means of a particular kinematical interpretation combined with a principle of continuity.

In an earlier paper the authors discussed some super-tasks by means of a kinematical interpretation. In the present paper we show a semi-formal way that a more abstract treatment is possible. The core idea of our approach is simple: if a super-task can be considered as a union of (finite) tasks, it is natural to define the effect of the super-task as the union of the effects of the finite tasks it consists of. We show that this approach enables us (...) to handle two of the three super-tasks that we discussed earlier. We also argue that recent objections against our original kinematical interpretation do not hold water. One of our arguments is based on the construction of an elegant correspondence between the first of those three super-tasks and Zeno's Achilles and the Tortois. (shrink)

While corporate social responsibility (CSR) is becoming a mainstream issue for many organizations, most of the research to date addresses CSR in large businesses rather than in small- and medium-sized enterprises (SMEs), because it is too often considered a prerogative of large businesses only. The role of SMEs in an increasingly dynamic context is now being questioned, including what factors might affect their socially responsible behaviour. The goal of this paper is to make a comparison of SME and large firm (...) CSR strategies. Furthermore, size of the firm is analyzed as a factor that influences specific choices in the CSR field, and studied by means of a sample of 3,680 Italian firms. Based on a multi-stakeholder framework, the analysis provides evidence that large firms are more likely to identify relevant stakeholders and meet their requirements through specific and formal CSR strategies. We examined whether facial expressions of performers influence the emotional connotations of sung materials, and whether attention is implicated in audio-visual integration of affective cues. In Experiment 1, participants judged the emotional valence of audio-visual presentations of sung intervals. Performances were edited such that auditory and visual information conveyed congruent or incongruent affective connotations. In the single-task condition, participants judged the emotional connotation of sung intervals. In the dual-task condition, participants judged the emotional connotation of intervals while performing a secondary (...) task. Judgements were influenced by melodic cues and facial expressions and the effects were undiminished by the secondary task. Experiment 2 involved identical conditions but participants were instructed to base judgements on auditory information alone. Again, facial expressions influenced judgements and the effect was undiminished by the secondary task. The results suggest that visual aspects of music performance are automatically and preattentively registered and integrated with auditory cues. (shrink)

This debate, I shall argue, has everything to do with Aristotle. Aristotle raises the charge of epiphenomenalism himself against a theory that seems to have close affinities to his own, and he offers what has the makings of an emergentist response. This leads to controversy within his own school. We find opponents ranged on both sides, starting with his own pupils, several of whom are stout defenders of epiphenomenalism, and culminating in the developed emergentism of later commentators. Aristotle’s theory and (...) the debate that ensued are thus quite relevant to contemporary discussions. But first we need to get clear on terms. (shrink)

In this article, we will make the case for an intercultural philosophy of religion with a special focus on interculturality between Chinese and African philosophies. We will provide an overview of the kind of intercultural philosophy that has already been undertaken between the East and the South and point out that a philosophy of religion has been left out. We will then make the case for a global philosophy of religion approach and why Chinese and African philosophies of religion should (...) engage in philosophical interchanges. We will then highlight some directions for carrying out such a philosophy and explain why the problem of evil may be better addressed from an intercultural perspective. (shrink)

In the Spanish-Indian controversies, special attention was given to the subject of the education of the Indians, understood in a first approach as the necessary procedure to enable them to overcome their barbarianism, that is, to better adapt themselves to the natural law. This generated a philosophy of education which, in spite of being directly inspired by the circumstances of the Indians, nonetheless had permanent value by virtue of its anthropological soundness and its classical approach. Certain distinctively patristic and medieval features may be traced in Spanish-Renaissance thought, a tradition in which Aristotelianism played an otherwise dominant role. The study of these features may help to better understand the place of Hispanic thought in Renaissance intellectual history. I focus on one such a feature, providentialism, as it can be seen in two representative authors of sixteenth-century Spanish historiography. By discussing their differing providentialist views, and their motives for adopting them in each author’s historical and political circumstances, (...) it is argued that the zeal for justice constitutes a distinctive trait of Spanish-Renaissance thought. ABSTRACT There has been much discussion regarding the acceptable use of sedation for palliation. A particularly contentious practice concerns deep, continuous sedation given to patients who are not imminently dying and given without provision of hydration or nutrition, with the end result that death is hastened. This has been called ‘early terminal sedation’. Early terminal sedation is a practice composed of two legally and ethically accepted treatment options. Under certain conditions, patients have the right to reject hydration and nutrition, even (...) if these are life‐sustaining. Patients are also entitled to sedation as palliation for intolerable, intractable suffering. Though early terminal sedation is thought to be rare at present, the changing nature of palliative medicine suggests its use will increase. Arguments regarding early terminal sedation have failed to recognize early terminal sedation as a distinct legal and ethical entity. It can be seen as both the simple sum of treatment refusal and sedation for palliation, analogous to terminal sedation. It can also be seen as an indivisible palliative treatment, more analogous to assisted suicide or euthanasia. But ultimately, it is wholly analogous neither to terminal sedation given when death is imminent, nor to assisted suicide or euthanasia. This paper contends that early terminal sedation should be considered as a distinct entity. Such a reconception promises to provide a way forward in the debate, practice and policy regarding this contentious area of palliative medicine. (shrink)

In "De anima" 3.5, Aristotle argues for the existence of a second intellect, the so-called "Agent Intellect." The logical structure of his argument turns on a distinction between different types of soul, rather than different faculties within a given soul; and the attributes he assigns to the second species make it clear that his concern here -- as at the climax of his other great works, such as the "Metaphysics," the "Nicomachean" and the "Eudemian Ethics" -- is the difference between (...) the human and the divine. If this is right, we needn't go on a wild goose chase trying to invent a role for the so-called Agent Intellect to play. God moves our intellects as he moves the heavenly spheres, "as a beloved": he constitutes the complete actualization towards which all of our intellectual striving is directed. Aristotle regards such final causation as an efficient cause, but not in a way that would make it part of what we would call the causal processes or mechanisms of human psychology. But, he would insist, it is essential for appreciating who we are and what our place is in the world. (shrink)
